How Washington’s New DUI Law Will Impact Offenders

Earlier this year, lawmakers in Washington state unveiled a number of new laws which greatly increase the maximum penalties that those convicted of Driving While Intoxicated (DWI) and Driving Under the Influence of alcohol or drugs (DUI).  In addition to previous penalties, already some of the toughest in the country, those charged with either crime may face mandatory jail time, strictly enforced court appearances, and lengthy house arrest.  Furthermore, under Washington’s new laws, even being charged with DUI can result in the suspension of your license, even if you are later declared to be not guilty.

House arrest, or Electronic Home Detention (EHD), periods for DWI convictions in Washington last for fifteen days of EHD per one day of “real” jail time deferred.  In other words, if the normal sentence would be three days of jail time (about average for a first time conviction,) the presiding judge may instead elect to impose 45 days of EHD on the offender.  While under EHD, the offender is required to wear a GPS device to track his or her movements, which will send an automated alert to local law enforcement whenever he or she exits the bounds set during sentencing.
